The EU Commission has published its long-awaited Draft Directive on Sustainability Due Diligence that establishes a European framework for companies to ‘protect, respect, and remedy’ human rights and environment-related risks in their operations and supply chains. The proposed Directive is a landmark piece in the long history of human rights obligations on private companies and also an integral part of the EU Green Deal. It raises an array of legal and political questions, ranging from the regulatory ambition and ideals to enforcement and implications for corporate practice (liability, third-party verification) and the role of the EU in the fragmented regulatory landscape on corporate accountability. In this panel, voices from academia, civil society and legal practice will share initial legal assessments and discuss some of the most salient questions for the upcoming legislative process.
