EC study on mandatory rules on contractual obligations

EC tender N° JUST/2015/RCON/PR/CIVI/0066

Prof. Marco Loos and Dr Joasia Luzak join a team of legal experts, coordinated by the University of Paris 1 Panthéon-Sorbonne, to conduct a Study on all mandatory rules applicable to contractual obligations in contracts for sales of tangible goods sold at a distance and, in particular online.

The University of Paris 1, Panthéon-Sorbonne submitted an offer in response to the EU invitation to tender for the Study on all mandatory rules applicable to contractual obligations in contracts for sales of tangible goods sold at a distance and, in particular online (EU tender N° JUST/2015/RCON/PR/CIVI/0066). They won the bid. As part of the team, Marco and Joasia will write a Dutch report on the subject, containing:

  • National mandatory rules applicable to contractual obligations, which transpose the minimum harmonisation European  acquis, i.e. the Consumer Sales Directive or the Unfair Contract Terms Directive on unfair terms, conformity and remedies
  • National mandatory rules applicable to contractual obligations in B2C contracts for sales of tangible goods at a distance, in areas where there is no European  acquis (including areas of national general contract law which do not necessarily fall within the concept of consumer law). The contractor does not have to deal with national rules transposing the Consumer Rights Directive
  • National mandatory rules applicable to contractual obligations in B2B contracts for sales of tangible goods at distance
