BEUC study on the European Commission proposal for a directive on consumer rights

Prof. Marco Loos writes a study for BEUC called 'A critical analysis of the proposal for a consumer rights directive'.

In this study Marco Loos identifies and distinguishes two different sets of rules in the proposal:

  • rules where full harmonization could be an appropriate too to eliminate legal fragmentation while providing benefits for consumers
  • rules which should remain under the principle of minimum harmonization (such as rules on unfair contract terms)

He also identifies issues where the delimitation of the harmonized field is unclear and/or problematic.
